FOREIGN NATIONALS IMMIGRATION TO THE US

The US provides different visa categories to non-US citizens who wants to come here to work, study, travel, receive medical attention, or for other reasons, the Immigration and Nationality Act provides several classifications for foreign national to visit the United States for permanent and specific temporary periods.

Foreign nationals in the United States are described as Non-immigrants and Immigrants. Those foreign nationals that intend to stay in the United States for an extended period are issued “Immigrant Visas” hence they are called Immigrants. On the other hand, foreign nationals that intend to visit the United States for a short period of time for purposes of Work, School, seeking medical attention, tourism, etc. are issued temporary Visas and are called Non-Immigrants. Individuals seeking Non-immigrant Visas usually apply at a U.S. Consulate in their country of origin.

To be clear, applying for and obtaining a Visa to travel to the U.S. does not guarantee a foreign national admission to the US. The consular officer at the port of entry, i.e., airport, seaport, or land border will make the final determination on whether the nonimmigrant is “admissible” (In other words they have not violated or intend to violate any of the laws or rules of the US).

US VISA WAIVER POLICY

The US allows citizens of certain countries to travel to the US without a visa for a short period of 90 days or less for pleasure or business as non-immigrant visas. However, there are specific requirements attached to applying for these visas. The applicant must A) Complete an arrival/departure form known as I-94 B) Have a passport that is capable of being read by a machine, and that is valid for at least 6 months beyond the period of intended stay. C) Be arriving on a carrier that is designated as a signatory to the visa waiver program agreement.
